Terms of Service

These terms govern your use of mysite-name's design agency services across England. Please read them carefully before commencing any creative projects to ensure a clear understanding of our working approach, client responsibilities, and the project delivery process.

1. Service Agreement

By engaging our design services—whether through project proposals, service agreements, or creative briefs—you agree to these terms. Our design services operate in compliance with relevant UK creative industry standards and intellectual property laws.

We provide professional design services through our creative team across England, offering branding, web design, product design, and strategic consulting.

2. Service Scope and Creative Standards

Our services include brand development, digital design, print design, and business consulting. We focus on providing quality creative work using established design principles and contemporary practices.

While we deliver work to professional standards, creative outcomes can be influenced by project parameters, client feedback, and market context. We provide strategic recommendations and use our creative expertise to develop effective design solutions.

3. Client Responsibilities

To ensure successful project outcomes, clients agree to:

  • Provide clear project briefs and background information
  • Designate a primary contact for project decisions
  • Provide timely feedback at agreed review stages
  • Supply necessary brand assets and reference materials
  • Adhere to agreed payment schedules

Clear communication and timely input significantly influence project progress and creative development.

4. Project Initiation and Planning

Our team will develop project plans based on your requirements and provide detailed proposals outlining scope, timelines, and investment. We establish clear project parameters to ensure alignment on deliverables and expectations.

We reserve the right to decline projects that conflict with existing client work or fall outside our areas of specialisation.

5. Proposals and Project Authorization

Project proposals are provided based on initial discussions and are valid for 30 days. Project commencement requires written approval of the proposal and payment of any required deposit. Creative work begins once authorization is received.

Significant scope changes during projects may affect pricing and timelines, which will be communicated and approved before proceeding.

6. Project Timelines and Milestones

Projects are structured around agreed milestones with specific deliverables and review points. Client feedback delays may impact subsequent milestones and final delivery dates.

We provide regular progress updates and maintain transparent communication about project status and any potential timeline adjustments.

7. Payment Terms

Payment schedules are outlined in project proposals. For projects exceeding £2,000, we typically require a 40% deposit before commencement, with balance payments tied to project milestones. Final deliverables are provided upon full payment.

Late payments may result in project pausing until the account is brought current. We reserve the right to withhold final assets and project files until outstanding payments are received.

8. Revisions and Refinements

Project proposals specify the number of revision rounds included. Additional revisions beyond the agreed number may incur extra charges. We strive to achieve client satisfaction while maintaining project viability and creative integrity.

Revision requests should be consolidated and specific to ensure efficient project progress. Major creative direction changes during later stages may require project re-scoping.

9. Intellectual Property Rights

Upon full payment, clients receive ownership of final designed assets as outlined in project agreements. We retain the right to display completed work in our portfolio unless otherwise agreed in writing.

Preliminary concepts, working files, and process materials remain our property unless specifically included in the project agreement.

10. Client-Supplied Materials

Clients are responsible for ensuring they have appropriate rights and permissions for any materials supplied for projects. We cannot be held liable for copyright infringement related to client-provided content.

We recommend clients maintain backups of all supplied materials, as we cannot guarantee recovery of lost or damaged client assets.

11. Project Cancellation and Termination

Projects may be terminated with written notice. For terminated projects, clients are responsible for payment of all work completed to date plus any committed costs. Deposits are non-refundable once creative work has commenced.

We reserve the right to terminate projects if clients fail to meet obligations or if working relationships become unproductive despite reasonable efforts to resolve issues.

12. File Storage and Archiving

We maintain project files and working documents for 12 months after project completion. Clients are responsible for archiving their final assets. We recommend maintaining secure backups of all delivered files.

Long-term archiving of project files beyond 12 months may be available as a paid service upon request.

13. Liability Limitations

Our liability for services is limited to the project fee paid. We cannot accept responsibility for business outcomes, market reception, or results influenced by factors beyond our control, including client implementation of delivered work.

We maintain appropriate professional indemnity insurance and follow industry best practices in our creative processes.

14. Terms Modification

We reserve the right to update these terms periodically to reflect changes in our services, UK regulations, or industry practices. The current terms are always available on our website, and continued use of our services constitutes acceptance of any updates.
